Overview
Working a Second Job and Claiming Long-Term Sick – A Leeds-based logistics company contacted Private Detective Leeds after becoming increasingly concerned about an employee who had been absent from work for several months due to an alleged back injury.
The employee claimed they were unable to perform their duties and continued to receive company sick pay. However, colleagues reported seeing the individual carrying out physically demanding work elsewhere.
The employer needed reliable evidence before taking any action. As a result, Private Detective Leeds was instructed to conduct a discreet investigation and establish the facts.
Concerns Raised by Management
The employee had worked for the company for several years and was considered a trusted member of staff. Initially, management supported their absence and followed all appropriate procedures.
However, concerns developed when several employees reported seeing the individual driving a commercial vehicle and carrying equipment at another location within Leeds.
The reports could not be verified internally. Therefore, the company required independent evidence to determine whether the employee was genuinely unable to work or was abusing the sick leave process.
Planning the Investigation
Private Detective Leeds reviewed the information supplied by the client and identified several locations linked to the allegations.
Our investigators developed a surveillance strategy designed to establish the employee’s daily activities while ensuring complete discretion throughout the operation.
The objective was straightforward. We needed to determine whether the employee’s activities were consistent with the medical limitations they had reported to their employer.
Surveillance Identifies a Second Job
During the first week of surveillance, investigators observed the employee leaving their home early in the morning and travelling to a commercial premises on an industrial estate in Leeds.
The individual remained at the location throughout the working day and appeared to be undertaking regular employment duties.
Over several days, our surveillance team documented the employee unloading equipment, lifting heavy items, climbing in and out of vehicles and carrying materials around the site.
These activities appeared inconsistent with the severe physical limitations previously reported to the employer.
Importantly, all observations were recorded and documented to Evidence to a Court Standard.
Gathering Further Evidence
To establish whether this activity formed part of ongoing employment, investigators continued monitoring the individual over a number of weeks.
The surveillance revealed a clear and consistent pattern.
The employee attended the same workplace on multiple occasions each week and routinely completed full working days. Investigators observed them undertaking manual tasks, operating equipment and interacting with colleagues in a manner consistent with regular employment.
Furthermore, the individual showed no visible signs of the mobility restrictions described in documentation supplied to the employer.
As the investigation progressed, our team compiled a detailed timeline demonstrating repeated attendance at the secondary workplace during periods when the employee remained signed off from their primary employment.
Evidence Prepared to a Court Standard
Once sufficient evidence had been obtained, Private Detective Leeds prepared a comprehensive evidential package for the client.
The report included:
- Surveillance logs
- Date and time-stamped photographs
- Vehicle movement records
- Activity summaries
- Detailed timeline analysis
- Investigator witness statements
Every element of the investigation was prepared to Evidence to a Court Standard and presented in a clear format suitable for employment proceedings.
The Outcome
Following a review of the evidence, the employer commenced formal disciplinary procedures.
When confronted with the findings, the employee struggled to explain the activities documented during the investigation. The evidence demonstrated that they had been carrying out physically demanding work whilst continuing to claim they were medically incapable of performing their role with the client.
The company was able to make informed decisions based upon independently obtained evidence rather than suspicion or workplace rumours.
In addition, the investigation helped protect the business from ongoing financial losses associated with extended sick pay and staff cover arrangements.
Why Employers Investigate Suspected Sick Leave Abuse
Most employees who take sick leave are entirely genuine. However, when concerns arise, employers need evidence rather than assumptions.
Professional surveillance can establish the facts while helping employers comply with employment law and internal procedures. Furthermore, independent evidence often provides clarity in situations where conflicting information has created uncertainty.
